Welcome to Digital Finance Wave ("the Agency", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and usage of the digitalfinancewave.info platform, our interactive calculators, subscription systems, and developer REST APIs. Please read these Terms thoroughly before using our systems.

By accessing any portion of our platform, submitting your email on subscription forms, or engaging with our quant wealth services, you signify that you have read, understood, and agreed to be legally bound by these Terms and our associated Privacy Policy. If you do not agree to these Terms, you must immediately cease platform access.

1. Client Eligibility & Representation

To use our services, create API sandbox keys, or consult with our strategists, you represent and warrant that:

• You are at least 18 years of age and possess the legal capacity to enter into binding financial and technical agreements.
• If onboarding on behalf of a corporate entity, you possess direct corporate authorization to bind said entity to these Terms.
• You are not located in a country subject to United States OFAC sanctions or classified as a prohibited party on governmental trade restrictions.

2. Technical API Usage & Licensing

Clients utilizing our corporate treasury REST/gRPC APIs are granted a limited, non-exclusive, non-transferable, and revocable license to access our systems under the following constraints:

• Rate Limits: API calls must conform to standard rate boundaries (e.g. 100 requests per minute for Growth accounts). Flooding API gates will result in instant IP blacklist blocks.
• Security: You are solely responsible for securing your API private keys. Digital Finance Wave will not be liable for losses resulting from compromised tokens.
• Prohibited Actions: You may not attempt to reverse-engineer our Smart Yield Routing algorithms, inject malicious script packets, or bypass transaction multi-sig layers.

3. Algorithmic Yield Disclaimers

The interactive ROI and compound calculators on digitalfinancewave.info are strictly for mathematical simulation and illustrative purposes. Please note the following critical disclosures:

• Not Financial Advice: Digital Finance Wave is an algorithmic fintech platform provider. Platform information does not constitute fiduciary investment or legal advisory services.
• Liquidity Variables: Digital yields are computed based on historical compound index distributions. Future markets fluctuate, and historical performance guarantees no future outcomes.
• Risk Representation: Digital assets and compounding liquidity pools contain market-dependent volatility. Clients acknowledge that asset depreciation is a viable market risk.

4. Platform Service Uptime SLA

While we target an institutional-grade 99.99% API and dashboard server uptime, we make no structural guarantee of uninterrupted platform access. Database migrations, grid routing updates, and clearing network updates may trigger scheduled maintenance windows, which we will notify clients of in advance whenever possible.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Digital Finance Wave, its executive quant directors, engineers, and clear partners will not be liable for any indirect, incidental, special, punitive, or consequential damages. This includes, but is not limited to, losses of capital yields, database connection timeouts, API hacks, or transaction settlement delays, even if advised of the possibility of such damages.

6. Dispute Resolution & Arbitration

These Terms, your platform access, and relations with Digital Finance Wave are governed strictly by the laws of the State of California, USA, without regard to conflict of law principles.

Any legal dispute, claim, or controversy arising out of these Terms or platform access will be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in the City and County of San Francisco, California. Both parties waive their rights to jury trials or class action participations.

7. Term Terminations

We reserve the absolute right to suspend, terminate, or block client API keys, email newsletters, and database dashboard access at our sole discretion, without prior notice, if we detect breaches of these Terms, suspected transaction wash-trading, or credit card carding attempts.
